1. Agreement to these terms
These Terms & Conditions (“Terms”) are a legal agreement between the person or organisation using PGYatra (“you”, “your” or “Customer”) and the operator of PGYatra (“PGYatra”, “we”, “us” or “our”). They govern the PGYatra mobile app, pgyatra.com, public forms, support and related services that link to these Terms (together, the “Service”).
By creating an account, starting a trial, purchasing a subscription or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you use PGYatra for a business or organisation, you confirm that you have authority to bind it. If you do not agree, do not use the Service.
2. Eligibility
You must be legally capable of entering a binding contract and, in all cases, at least 18 years old to create a PGYatra owner account. You may use the Service only for lawful PG, hostel, co-living, rental-accommodation or related property operations. The Service is currently intended for users operating in India.
3. Accounts and authorised users
You must provide accurate, current information and keep it updated. You are responsible for protecting login credentials, controlling who can access your account and all activity performed through it. Do not share credentials with an unauthorised person. Notify us promptly at support@pgyatra.com if you suspect unauthorised access or loss of a device connected to your account.
If you allow employees, managers or other team members to use your account, you are responsible for their compliance with these Terms and for assigning only the access they need.
4. The Service and your licence
Subject to these Terms and payment of applicable fees, PGYatra grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business operations during your trial or subscription. The Service helps organise tenant, property, rent, complaint, expense, contact and analytics records. Features may vary by platform, version, plan or release status.
5. Customer and tenant data
You retain your rights in the information, records and content you or your users submit to the Service (“Customer Data”). You give PGYatra permission to host, copy, process, transmit, back up and display Customer Data only as needed to provide, secure, support and improve the Service, comply with law and enforce these Terms.
You are responsible for Customer Data and confirm that:
- you have the right and lawful basis to collect, use and provide it to PGYatra;
- you have given tenants and other individuals any privacy notice and obtained any consent required by law;
- the data is relevant, reasonably accurate and not misleading;
- your collection and use do not violate privacy, consumer, housing, anti-discrimination, communications or other applicable laws; and
- you will respond appropriately to requests from individuals whose data you control.
Our handling of personal information is further described in the Privacy Policy.
6. Public forms
The Service may let you publish joining or complaint links. Anyone with a valid link may be able to submit information to the associated PG account. You are responsible for sharing links with the intended audience, reviewing submissions before relying on them, restricting access when no longer needed and handling submitted information lawfully. Do not use public forms to request unnecessary sensitive information.
7. Acceptable use
You must not, and must not assist another person to:
- use the Service for an illegal, fraudulent, deceptive, discriminatory, harassing or harmful purpose;
- upload content that infringes privacy, confidentiality, intellectual-property or other rights;
- send spam, unlawful marketing, threats or abusive communications;
- attempt to access another customer's account or data without authorisation;
- probe, scan, overload, disrupt, bypass or defeat security or usage controls;
- introduce malware or use automated means to scrape the Service except through an interface we expressly permit;
- reverse engineer, decompile, copy, resell, sublicense or create a competing product from the Service except to the limited extent the law does not allow that restriction;
- misrepresent a payment record, tenant status, identity or affiliation; or
- use the Service in a way that could expose PGYatra, another user or any person to liability or security risk.
8. Tenant rent is outside PGYatra
PGYatra is an operational record-keeping service, not a bank, payment gateway, escrow service or money transmitter for tenant rent. We do not collect tenant UPI IDs for rent payment and do not receive, hold, settle or transfer rent between tenants and owners. You collect rent outside PGYatra and remain responsible for receipts, taxes, refunds, disputes and compliance related to those transactions.
A status such as “paid”, “partial” or “pending” reflects information entered by you. PGYatra does not independently verify that a rent transaction occurred.
9. WhatsApp and other communications
PGYatra may prepare reminder or notice text and open WhatsApp on your device. You decide whether to review and send it, and it is sent through your own WhatsApp account—not by PGYatra. You are responsible for message content, recipients, timing, consent and compliance with applicable law and WhatsApp's terms. Transactional emails and push notifications sent by PGYatra are described in our Privacy Policy.
10. Free trial
Eligible new accounts currently receive a one-month free trial. The app will show the applicable trial duration, payment method and conversion conditions before you subscribe. If you authorise a recurring subscription when starting the trial, the paid monthly plan begins and the displayed fee is charged when the trial ends unless you cancel before the stated deadline. A trial may be limited to one per person, business, device or payment method, and we may refuse or end a trial where we reasonably detect abuse.
11. Subscription, billing and taxes
The current standard subscription is ₹499 per month and includes the features described for that plan, subject to any fair-use, technical or platform limits disclosed in the Service. Subscription payments are processed through Razorpay. By authorising a recurring payment mandate, you permit the applicable payment provider to charge the displayed fee at each renewal until cancellation.
Prices, billing frequency, inclusions and applicable taxes will be shown before purchase. Taxes may be added where required. You must keep billing details current. If a payment fails, we may retry it, notify you, restrict paid features or move the account to a limited state.
12. Renewal, price changes and cancellation
A paid monthly subscription renews for successive monthly periods unless cancelled before the next renewal date. You can cancel using the controls made available in the app or by contacting support if those controls are unavailable. Cancellation stops future renewal; access to paid features ordinarily continues until the end of the already-paid period.
We may change prices or plan structure. For an existing paid subscription, we will give reasonable advance notice before a price change applies to a future renewal. If you do not accept the change, you may cancel before it takes effect.
13. Refunds
Except where applicable law requires otherwise or we expressly state a different policy at purchase, charges for a billing period that has begun are non-refundable and we do not provide credits for partial periods or unused features. Nothing in these Terms limits a mandatory consumer remedy available under law. To report a duplicate or incorrect charge, contact support with the transaction reference.
14. Account status after a subscription ends
After a trial or paid period ends, some features may be disabled and the account may enter a read-only or limited state. We may retain data for a reasonable reactivation period as described in our Privacy Policy. You should export records you need before closing an account. We do not promise indefinite storage for an inactive or cancelled account.
15. Service changes, availability and beta features
We continually update the Service and may add, modify, limit or remove features to improve performance, address security or legal requirements, or reflect product demand. We will try to provide reasonable notice if a material change significantly reduces a paid core feature.
The Service may occasionally be unavailable because of maintenance, internet or provider failures, emergencies or events outside our reasonable control. Preview, early-access or beta features may be incomplete, changed or withdrawn and may have additional conditions. We do not guarantee that the Service will always be uninterrupted or error-free.
16. Support
Support is available through support@pgyatra.com. We aim to respond promptly, but response and resolution times are not guaranteed unless we separately agree to a written service level. You agree to provide reasonable diagnostic information and cooperate in troubleshooting.
17. Third-party services
The Service relies on or links to third-party products such as cloud infrastructure, Razorpay, WhatsApp, Google Play and the Apple App Store. Your use of an independent third party may be governed by its own terms and privacy policy. We do not control and are not responsible for third-party services, payment networks, communication platforms or their availability, except to the extent responsibility cannot lawfully be excluded.
18. PGYatra intellectual property
PGYatra and its licensors retain all rights in the Service, including the software, design, branding, documentation and content we provide. Except for the limited licence in these Terms, no right is transferred to you. You may not remove legal notices or use PGYatra names, logos or marks without prior written permission.
If you voluntarily provide product feedback, you allow us to use it without restriction or payment, provided we do not publicly identify you without permission.
19. Suspension and termination
You may stop using PGYatra at any time and may delete your account using available product controls. We may limit, suspend or terminate access if we reasonably believe you have materially breached these Terms, failed to pay applicable fees, created a security or legal risk, used the Service fraudulently, or if suspension is required by law.
Where practical, we will give notice and an opportunity to remedy the issue. We may act immediately when needed to prevent harm, protect data or comply with law. On termination, your licence ends. Provisions that by their nature should continue—including payment obligations, ownership, disclaimers, liability limits and dispute terms—survive.
20. Disclaimers
PGYatra is a management tool. It does not provide legal, tax, accounting, financial, housing or regulatory advice, does not guarantee rent collection or occupancy, and does not verify every record entered by a user. You remain responsible for business decisions, legal compliance, source documents, backups or exports you are required to maintain, and reviewing information before acting on it.
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
21. Limitation of liability
To the maximum extent permitted by law, PGYatra and its officers, employees, contractors and suppliers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for lost profits, revenue, goodwill, business opportunity or data, arising from or related to the Service.
To the maximum extent permitted by law, our total aggregate liability arising from or related to the Service will not exceed the amount you paid to PGYatra for the Service during the 12 months immediately before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited or excluded.
22. Indemnity
To the extent permitted by law, you will defend and indemnify PGYatra against third-party claims, losses and reasonable costs arising from your Customer Data, your unlawful or unauthorised use of the Service, your communications or rent transactions, or your material breach of these Terms. This obligation does not apply to the extent a claim was caused by PGYatra's own breach, negligence or wilful misconduct.
23. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Before starting formal proceedings, you and PGYatra agree to make a good-faith effort to resolve the dispute by emailing a written description to support@pgyatra.com. If the dispute is not resolved, it may be brought before a court of competent jurisdiction under applicable law. Nothing here prevents either party from seeking urgent protective relief or using a mandatory consumer or statutory remedy.
24. Changes to these terms
We may revise these Terms to reflect product, business or legal changes. The updated version will be posted here with a new effective date. We will provide additional notice before a material change takes effect where appropriate. By continuing to use the Service after revised Terms become effective, you agree to them; if you do not agree, you must stop using the Service and cancel any future renewal.
25. General provisions
These Terms and policies expressly incorporated into them form the entire agreement about the Service unless you have a separate written agreement with us. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganisation, sale of business or by operation of law. Neither party is liable for delay caused by events beyond reasonable control, except for payment obligations already due.
26. Contact
For account, billing, product or legal questions, email support@pgyatra.com. Include your registered email address and enough detail for us to identify and respond to the issue.
